In short

Students have a right to privacy, with one limit: if a student or someone else is in danger. Information about a student’s gender identity, legal name or biological sex at birth is confidential and is not disclosed without the student’s express consent.

The right, and its limit

All KSIM students have a right to privacy with limitations. Those limitations include if a student or someone else is in danger to themselves or others.

That limit is why every member of staff is mandated to report wellbeing concerns — see safeguarding & child protection.

Confidentiality of gender identity

This is reproduced without changes because it sets out a specific confidentiality obligation on school personnel.

Students have the right to maintain privacy of their gender non-conforming status. Information about students’ gender identity, legal name, or biological sex at birth are considered confidential. Personnel of KSIM should not disclose information about a student that would violate their right to confidentiality on these matters to others, including other KSIM community members, unless the student has expressly consented to the sharing of such information. In all deliberations, the psychological and physical wellbeing of the student will be a major consideration.

How breaches are handled

All reported breaches of Diversity, Equity and Inclusion will be investigated by the appropriate School Administration, with the involvement of the school pedagogue/counsellor and any other appropriate person.

Any established breach is regarded as a breach of the Student Code of Conduct or the Faculty Code of Professional Conduct.
